“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

Plan ahead in case of an ICE related emergency.
This legal service is designed for the commercial client who wants confidential legal advice from a hired attorney. Plan ahead with an advocate who can be rapidly available if ICE comes to your workplace or encounters your organization.
To protect your rights, we draw upon specialized training and experience with federal agents, warrants, searches, seizures, and the reasonable expectation of privacy protected by the United States Constitution.
Some areas of your premises are non-public and places you may reasonably expect to be protected from government intrusion. We will schedule a walk through and evaluation of the private and public areas of the workplace. We will also discuss exceptions to a warrant requirement that could apply to your situation.
There are outstanding non-profits providing information to the general public and individuals about how to handle ICE raids. This service is for businesses and organizations that want to have their own lawyer involved and ready. This is a good fit for businesses and organizations that value confidential advice, a private site visit, customized training, and preparedness. Knowing your rights as a business or nonprofit is critical to protect your workplace from unlawful intrusions by ICE.
You may also be in need of immigration or employment law advice and related expertise. Please note we are not immigration or employment attorneys. You may want to seek experienced, specialized legal advice on those subjects from other professionals. Our goal is to provide affordable advice and access to counsel concerning how to respond to an ICE encounter or raid.

As the news headlines overflow with stories of ICE raids and dragnets targeting foreign-born workers, business owners and nonprofits are asking the following questions:1) What parts of your property and business operations are private and what parts are open to the public?
2) Are the private areas of your premises appropriately marked? Law enforcement, including ICE, may have authority to enter spaces open to the public.
3) What is your plan if ICE comes to your workplace? Has your team been trained on the best practice of how to handle that legally and safely?
4) What is the difference between a judicial warrant to search a premises and an ICE warrant? What is the scope of an ICE warrant as it applies to your work place?

If ICE visits your place of business, what are your rights?
The Fourth Amendment to The United States Constitution protects you and your workplace from unreasonable searches and seizures. The official text provides:
“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”The Fourth Amendment balances the government's need to investigate and enforce the law with the individual's right to be free from unwarranted government intrusion. Furthermore, "the people" who are protected by the Fourth Amendment are not just American citizens. The Fourth Amendment also offers protection to non-citizens living among us in the United States.
